Terms and Conditions
PROMOTION: Dr. LeWinn’s Beautiful Bodycare Prize Pack including Dr. LeWinn’s MEN Prize Pack
1. Information on ‘how to enter’ and prize details forms part of these conditions of entry. Entries not completed in accordance with these terms and conditions or received after the closing date will not be considered.
2. The promotion commences on 00:01am, 14th September 2009 and final entries close at 11:59pm, 30 April 2010 (“Promotion Period”). No responsibility is accepted for lost, late or misdirected entries.
3. Entry is open to residents of Australia only aged 18 years of age or over. Employees of the Promoter and their immediate families are ineligible to enter.
4. Participants can enter via the Vibe Village Website – www.vibevillage.com.au Entry into the competition is free and only valid if all details provided on entry are completed.
5. All entries become the property of the Promoters. The Promoter reserves the right to use the content of winning and runners-up entries (including the entrants’ names, addresses and telephone numbers) for the purpose of future promotions, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
6. This is a game of skill with entrants required to:
6.1. sample one (1) or more of the following six (6) different Dr. LeWinn’s product ranges: Puressence, Line Smoothing Complex S8, Ultra R4, Revitanail, Vitamin A or MEN (“the Products”).
6.2 complete a testimonial on their personal experience with one (1) or more of the Products (“the Report”) at any time during the Promotion Period; and
6.3 post or upload the Report to the Dr. LeWinn’s Beauty Clinic Testimonial Wall as directed on the Vibe Village Website at any time during the Promotion Period.
7. Each entrant acknowledges and agrees to their Report or any aspect of their Report (including but not limited to photos, videos and commentary) which is submitted by them during the Promotion Period being used by the Promoter and distributed to any third party for publication or future use of whatever nature with no right of compensation or other action or claim.
8. Each entry will be judged on an individual basis and a total of thirty-five (35) prize winners will be selected from all correct entries received during the Promotion Period. Out of those thirty-five (35) prize winners, five (5) will be selected from Reports relating to each of the following five (5) different Product ranges: Puressence, Line Smoothing Complex S8, Ultra R4, Revitanail, Vitamin A and ten (10) will be selected from Reports relating to the Dr. LeWinn’s MEN range. The Promoter in determining the winners will take into account:
8.1. the quality of the photo, commentary and Report uploaded in accordance with Clause 6.3; and
8.2 the Product range that the Report relates to.
An entrant may post multiple Reports based on each different Product sampled, however only one (1) prize will be awarded per entrant. Competition winners will be notified by email within seven (7) days of the promotion closing date. Details of the winner will also be published at www.vibevillage.com.au
9. The Promoter’s decision in relation to any aspect of this promotion including the selection of competition winners is final and binding on every person who enters. No correspondence will be entered into.
10. Prizes:
10.1. Each prize winner from these product ranges: Puressence, Line Smoothing Complex S8, Ultra R4, Revitanail, Vitamin A will receive one (1) ‘Beautiful Bodycare prize pack’ containing one (1) ‘Liquid Loofah’ Mineral Body Scrub, 150mL (valued at $29.95), and one (1) ‘ToneUp’ Body Moisturiser, 200g (valued at $39.95). The total ‘Beautiful Bodycare prize pack valued at $69.90.
10.2 Each prize winner from the Dr. LeWinn’s MEN product range will receive one (1) ‘Dr. LeWinn’s MEN Prize Pack’ containing one (1) Face Scrub, 100g, one (1) Shaving Cream 150g and one (1) 1GB USB Stick. The total ‘Dr, LeWinn’s MEN Prize Pack’ valued at $44.90AU.
10.3. The Prize will be delivered to each winner at no extra cost.
10.4. The total prize pool is $2,196.50.
10.5. All information relating to prizes, products and fact sheets in connection with this promotion, and the Dr. LeWinn's Beauty Clinics more generally, have been provided by Dr. LeWinn’s and the Promoter will not be held liable for any inaccuracies.
11. All prizes include GST and prize value is based on recommended retail value as provided by the supplier and is correct at the time of printing. Any change in the value of prizes between the publishing date and the date prizes are delivered is not the responsibility of the Promoters.
12. Delivery details of all prizes will be specified by email to the competition winners and will include an expiry date for delivery. Any prizes that remain undelivered or unclaimed by the competition winner after the expiry date or within 60 days of the intended delivery date where no expiry date is specified will be forfeited by the competition winner.
13. The Promoter accepts no responsibility for loss or damage to prizes in transit. The Promoter makes no representations or warranties as to the quality/suitability of any of the goods/services offered as prizes.
14. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Except with the written consent of the Promoter, prizes are not transferable or exchangeable and cannot be taken as cash. The Promoter has absolute discretion as to whether it will provide such consent and need not provide any reasons to any person for providing or withholding consent.
15. The Promoter may in its absolute discretion suspend, cancel or recommence the promotion if:
15.1. for any reason the promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion; or
15.2. the determination of the prize winners or the delivery of the prizes is prevented or hindered by any outside agent or event including but not limited to vandalism, power failure, tempest, natural disaster, acts of God, civil unrest or strikes or other industrial action.
16. To the full extent permitted by law, the Promoter will not be liable in respect of any claim for any loss or damage whatsoever, (including, without limitation, any consequential, indirect, special, punitive or incidental damages by reason of any act or omission, deliberate or negligent, by the Promoter, or its agents) or for any personal injury suffered by an entrant or participant in connection with the promotion. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.
